2. Acceptance of these Terms
By accessing or using our website, or by booking or paying for our services, you agree to these Terms (as amended from time to time).
If you do not agree, please do not use our website or book our services.
3. Our services (general)
We provide photography and videography services (including, for example, weddings, couples/engagements, family sessions, events, sports, corporate/brand content, and property/real estate content).
The specific services, inclusions, deliverables, timelines and pricing for any booking will be set out in a proposal, invoice, booking confirmation, and/or a separate written agreement.
4. Quotes, bookings, deposits and payment
4.1 Quotes
Quotes are typically valid for the period stated in the quote (or, if not stated, a reasonable period). Quotes may change if:
your requirements change (hours, locations, deliverables, travel, complexity)
your event date/time changes
external costs change (for example, venue access fees, third-party licensing, or travel).
4.2 Booking confirmation
A booking is not confirmed until we have received:
a signed acceptance (or written confirmation), and
any required deposit, and
any required booking information (such as date, times, location, and key contacts).
4.3 Payment
You agree to pay our fees in accordance with the invoice/booking terms. Late payments may delay delivery of galleries/films until payment is received.
5. Client responsibilities
You agree to:
provide accurate booking information (date, locations, timelines, deliverables)
obtain any permissions needed for us to film/photograph at a venue or location
ensure we can safely access the location(s)
cooperate with reasonable directions during shoots (including time required for portraits or set-ups)
ensure minors have appropriate parent/guardian supervision and any required permissions.
6. Artistic style and discretion
You acknowledge that photography/videography is a creative service. By booking, you agree that:
our style and editing approach is part of the service
the final selection of images and the final edit reflect our professional judgment.
Unless otherwise agreed in writing, we do not guarantee specific shots, angles, moments, or outcomes where circumstances are outside our control (for example, weather, lighting, venue restrictions, late schedules, guest behaviour, or safety issues).
7. Delivery timelines, galleries and file storage
7.1 Delivery
Delivery timelines vary depending on the service and season. Any estimated delivery timeframe is an estimate unless a guaranteed turnaround is expressly agreed in writing.
7.2 Online galleries and links
If we provide an online gallery or delivery link:
you are responsible for keeping the link/password secure
you should download and back up your files promptly
sharing the link may allow others to access the content.
7.3 Storage and retention
We may retain copies of project files and backups for a period of time after delivery, but long-term storage is not guaranteed unless agreed in writing.
8. Cancellations, postponements and rescheduling
8.1 Rescheduling
If you need to reschedule, please notify us as soon as possible. Rescheduling is subject to availability.
8.2 Cancellations
Cancellation terms (including whether any deposit is refundable) will be set out in your booking terms/service agreement. If no specific cancellation terms are provided, any deposit is generally used to reserve the date and may be non-refundable.
8.3 Force majeure
We are not liable for failure to perform or delay caused by events outside reasonable control (for example, severe weather, illness, accidents, equipment failure despite reasonable steps, venue closures, government restrictions).
9. Third-party services and products
We may use third-party providers for parts of our workflow (for example, website hosting, cloud storage, gallery delivery, payment processing, printing and albums, software tools).
We are not responsible for the acts or omissions of third-party providers. Third-party services may be subject to their own terms.
10. Intellectual property (copyright) and licences
10.1 Our ownership
Unless we agree otherwise in writing, we own the copyright and intellectual property rights in the photographs/films we create.
10.2 Your licence to use deliverables
Once you have paid all fees owing, we grant you a licence to use the final delivered images/films for personal use (and for business use, where that is the nature of the booking) as described in your service agreement. We do not generally supply RAW image files.
10.3 Restrictions
Unless we agree otherwise in writing, you must not:
sell the images/films
claim authorship
remove visible watermarks (if any)
use the images/films for unlawful, misleading, defamatory, or exploitative purposes.
11. Promotional use and consent
We may request your permission to use a selection of images/films for our portfolio, website and social media.
Your privacy choices and our handling of personal information are explained in our Privacy Policy (see the Privacy Policy page on this website).
If you do not consent to promotional use, that will not affect delivery of the services you booked.
12. Website use
12.1 Permitted use
You may use our website for lawful purposes only.
12.2 Prohibited use
You must not:
interfere with the website’s operation or security
attempt unauthorised access to our systems
upload or transmit harmful code
use our content (including images, films, text, branding) without permission.
13. Links to other websites
Our website may contain links to third-party sites. We are not responsible for the content, security, or privacy practices of third-party sites.
14. Limitation of liability (to the extent permitted by law)
To the extent permitted by law:
we exclude liability for indirect or consequential loss (such as lost profits, lost opportunity, or reputational harm)
our total liability for claims relating to a booking is limited to the amount you paid us for that booking.
Nothing in these Terms excludes any rights or remedies you may have under the Australian Consumer Law that cannot be excluded.
15. Complaints
If you have a complaint about our services or these Terms, please contact us using the details in section 1. We endeavor to solve all reasonable complaints and appreciate your feedback and cooperation.
16. Changes to these Terms
We may update these Terms from time to time. The latest version will be published on our website.
